TERMS AND CONDITIONS

In Australia, if your rental vehicle is involved in an accident, an excess typically applies. We
offer three levels of coverage to determine the amount of excess you will pay in case of an
accident.
You can organize extra liability cover through www.carhireexcess.com.au for peace of
mind. This coverage is not mandatory but recommended. It provides partial reimbursement for
damages, loss of business, etc. You are covered for up to $8,000 out of the maximum excess
reimbursement of the vehicle excess. Please review their policy and terms & conditions for
more details. Danny's Exotic Cars (DEC) is not associated with www.carhireexcess.com.au.

Maximum Liability:
Due to the high value of our luxury vehicles, the maximum liability for damages, loss of
business due to the vehicle being off-road, or breach of terms and conditions is specified for
each vehicle in the rental agreement. Please review this carefully for the vehicle you have
hired.

Cancellation Policy:
Any bookings cancelled will not receive a refund. However, as a goodwill gesture, we
provide rental credit with no expiry. This policy applies to all bookings, including those
cancelled for COVID-19-related reasons. Refunds or rescheduling with gift vouchers are not
available.

Bond:
The security bond is fully refunded within 7-12 business days from the vehicle return date,
provided there are no damages or breaches of terms and conditions.

Credit Card Surcharge:

A 2.2% credit card surcharge applies to all transactions.

Fuel:
The vehicle must be returned with a full tank of fuel. Proof of receipt for unleaded petrol,
98 premium or diesel must be provided. Failure to refuel will result in a deduction from
the bond, including the cost of refuelling plus $30.

Kilometre Allowance:
Please be aware of the kilometre allowance for your vehicle, as additional costs may apply
for exceeding this limit.

Late Return:
An additional late fee may apply if the vehicle is not returned on time. A grace period of up
to 60 minutes is allowed on a case-by-case basis.

Wheel/Rim Damages:
Damage to alloy wheels will incur a repair cost of $595 per wheel, which will be deducted
from the bond.

No Smoking Policy:
Smoking in the vehicle will result in a $495 fee deducted from the bond for sanitization and
deodorization.

Hooning/Dangerous Driving:
Traction control must not be turned off, and the vehicle must not be put into race/track
mode. Doing so will result in loss of bond, void insurance, and liability for damages.

Collision Damage Waiver:
Collision damage waiver is included in the rental agreement, limiting your liability for loss
or damage to the vehicle and third-party damage to the Accident Damage Excess (ADE)
specified on the rental agreement.

Prohibited Use:
If the loss or damage is caused by prohibited use of the vehicle, you are liable for the full
value of the vehicle and related losses and fees.

Appointment Times:
Please adhere to scheduled appointment times for pick-up and return. Notify us0 if you are
running late or early.
 

Rental Agreement:
This Rental Agreement formalizes the relationship between you and DEC. It is essential to
carefully read and understand the terms outlined here, as they include your legal
responsibilities and obligations during the Rental Period.

Outlined below are the terms and conditions associated with using any of our vehicles.

Disclaimer:

Only authorized persons can drive our vehicles. To be an Authorized Driver,
individuals must first be approved by us. Ensure all intended drivers are present at our
premises before renting.

Acknowledgment of Terms:
By signing this Rental Agreement, you confirm that you have read and understood its terms
and conditions. You also acknowledge and accept these terms, having had the opportunity
to seek independent legal and/or financial advice if needed.

Definitions:
Authorized Driver:
A person approved by DEC to drive the Vehicle, meeting specific criteria outlined in Clause 2 of this Rental Agreement.

Bond Guarantee Payment:
The payment specified by us and required prior to collecting
the keys for the Vehicle.

Emergency Contact:
The person and/or telephone number provided at the time of Vehicle collection.

Rental Period:
The duration of time specified in Section 2 of this Rental Agreement.

Vehicle:
The specific vehicle identified in Section 2 of this Rental Agreement.

We/Us/Our:
Danny's Exotic Cars (DEC).

You/Your:
The person signing this Rental Agreement, including any Authorized Driver.

Authorized Driver:
To drive the Vehicle, individuals must meet specific criteria outlined below and be
approved in writing by DEC:

  • Hold a valid Driver’s License allowing them to drive the Vehicle in the relevant Australian State or Territory.

  • Have no driving-related convictions in the last 3 years.

  • Not be under the influence of drugs or alcohol while driving the Vehicle, as defined in clause 2.3.

  • Be over the age specified in Section 2 and hold a full Driver’s License for at least 1 year before the Rental Period.

  • Have not been refused motor vehicle insurance or had a policy cancelled in the last 3 years.

Acceptable Vehicle Use and Conditions:
Outlined below are the permissible conditions for driving the Vehicle:

  • Drive only on suitably surfaced roads within Queensland unless otherwise authorized

  • Not use the Vehicle for media, film, photography, or advertisement without prior consent.
     


Proper Vehicle Use:
The Authorized Driver must ensure the following:

  • Adherence to specified passenger and load limits

  • Proper use of seat belts and child safety restraints

  • Prohibition of towing, illegal activities, excessive speeds, or carrying of prohibited materials

  • No smoking, consumption of food or liquid, or attachment of wedding ribbons without consent

  • Payment of Tolls, Fines, and Other Driving Fees

  • All tolls, fines, and fees incurred during the Rental Period are the responsibility of the authorised Driver

General Maintenance and Security:
The Authorised Driver must maintain proper vehicle condition, including fluid levels, refuelling, tyre pressure, and security measures.
 

Accidents and Vehicle Damage
Prompt notification of accidents or damage is required, along with cooperation in completing Accident/Damage Report Forms and providing necessary information.
 

Our Liability

We are not liable for loss or damage to property left in the Vehicle after return.
 

Damage Liability Fee
A fee applies to damage or misuse of the Vehicle during the Rental Period, covering repairs, towing, legal costs, and other expenses.
 

Payment Obligations
Payment of all fees is authorized to be charged to the provided credit card or deducted from the Bond Guarantee Payment.
 

Returning the Vehicle
The Vehicle must be returned in the same condition, during normal office hours, with all keys and accessories.
 

Rights Reserved
We reserve the right to cancel the Rental Agreement and take control of the Vehicle in certain circumstances.
 

Termination of Rental Agreement
If terminated within 24 hours of commencement, rental charges may still apply.
 

Applicable Law
The laws of Queensland and the Commonwealth of Australia govern this Rental Agreement.

Vehicle Condition, Tyre & Wheel Liabilities

The renter is responsible for maintaining the Vehicle's condition, including any tyre issues or damage.

Smoking
Smoking is prohibited in all DEC vehicles, with penalties for violations.
 

Speeding & Hoon Driving
Excessive speeding and Hoon driving are prohibited, with potential reporting to authorities and termination of the rental.
